Terms of Use

Acceptance and eligibility

By accessing or using the Services, you agree to these Terms of Use. If you do not agree, please do not use the Services. You must be old enough to form a binding contract and meet any applicable age requirements of your jurisdiction and the app store through which you access the Services. The Services are not directed to children under 13.

Accounts

You can browse the public wallpaper catalog and access eligible free content without creating an account. Some downloads and account-based features, including saving favorites and purchasing or restoring Chiwara Premium, require you to sign in. When you sign in, we create an authentication record linked to your email address and a pseudonymous user identifier.

You are responsible for keeping access to your account and device secure. We may suspend or terminate an account if we detect misuse, fraud, or a violation of these terms.

The Chiwara service

Chiwara offers a curated catalog of African-inspired wallpapers for modern mobile displays. The Services let you preview artwork, download eligible wallpapers, save favorites, and purchase or restore Chiwara Premium membership for access to additional content.

Catalog and artwork files are delivered through our hosting and storage providers. Download eligibility depends on your device platform, account status, and whether you have an active Premium entitlement.

Subscriptions, billing, and cancellation

Chiwara Premium is an auto-renewing subscription. The price, billing period, and currency shown in the app before purchase are the terms that apply to you. Apple or Google processes payments through your store account according to their own terms and privacy policies. We do not receive full payment-card details.

Your subscription renews automatically until you cancel it in the applicable store settings. Deleting the Chiwara app or deleting your Chiwara account does not cancel an active store subscription. You must cancel the subscription directly with Apple or Google.

If you previously purchased Premium and it is still active, the “Restore Membership” feature can restore your entitlement on the same platform. Refunds and billing disputes are handled by the applicable store, subject to mandatory consumer protection law where it applies.

Wallpaper license

When you download a wallpaper through the Services, we grant you a limited, non-exclusive, non-transferable license to use that wallpaper for personal display purposes only on devices that you own or control.

You may not sell, redistribute, sublicense, post publicly, use as stock, incorporate into merchandise, scrape, mine, or otherwise commercially exploit any wallpaper or artwork obtained through the Services without prior written permission from Chiwara.

Responsible use

You agree to use the Services lawfully and responsibly. You may not:

• attempt to gain unauthorized access to the Services or servers;
• interfere with other users or overload infrastructure;
• reverse engineer, decompile, or extract artwork or source code;
• use the Services to distribute malware, spam, or abusive content;
• circumvent security, licensing, or payment mechanisms.

Intellectual property

The Chiwara name, wordmark, branding, visual design, text, curated artwork, and original materials in the Services are owned by Chiwara and protected by applicable intellectual property laws. The limited license granted above does not transfer any ownership or broader rights.

Availability and changes

We do not guarantee that the Services will be uninterrupted, error-free, or available at any particular time. Chiwara may update features or catalog items, subject to applicable law and commitments shown when you subscribed. Subscription price changes and any required notice are handled through Apple or Google under the applicable store rules and consumer law. The Services are provided on an “as is” and “as available” basis to the extent permitted by law.

Suspension and account deletion

We may suspend or terminate access to the Services if you violate these terms or if necessary to protect the integrity, security, or lawful operation of the Services.

You may delete your Chiwara account from Account Settings in the Chiwara app. If you no longer have the app installed, you can request deletion through the account deletion page. Successful deletion removes your Supabase Auth user, favorites, Chiwara entitlement records, and the RevenueCat customer record associated with your account where present. It does not erase Apple or Google store purchase history or cancel an active store subscription.

Disclaimers and liability

To the fullest extent permitted by law, Chiwara disclaims all warranties not expressly stated in these terms. Chiwara will not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Services. Nothing in these terms limits liability that cannot be excluded under mandatory consumer protection or other applicable law.

App store terms

The Chiwara mobile applications are made available through the Apple App Store and Google Play. In addition to these terms, the applicable store terms, payment rules, refund policies, and privacy policies apply. Mandatory consumer protections and other rights granted to you by law remain in effect and are not reduced by these terms.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Services after an update constitutes acceptance of the revised terms. The effective date at the top of this page identifies the current version.
